1. Agreement to Terms

By accessing or using Aiunivers ("the Platform," "we," "our," or "us"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Platform.

These Terms constitute a legally binding agreement between you and Aiunivers. Please read them carefully before using our services.

2. Description of Services

Aiunivers provides an AI-powered image generation and editing platform that allows users to:

  • Generate images using various AI models
  • Edit and enhance images using AI-powered tools
  • Access Image Studio for advanced image manipulation
  • Utilize our API for programmatic access to AI capabilities
  • Access other AI-related tools and features as made available

3. Account Registration

To access the Platform, you must create an account. You agree to:

  • Provide accurate, current, and complete information during registration
  • Maintain and promptly update your account information
  • Maintain the security and confidentiality of your login credentials
  • Accept responsibility for all activities under your account
  • Notify us immediately of any unauthorized use of your account

You must be at least 18 years old to create an account and use our services.

4. Subscription and Payments

Access to the Platform requires a paid subscription. By subscribing, you agree to the following:

  • Billing: You authorize us to charge your payment method for the subscription fee on a recurring basis according to your chosen plan.
  • Price Changes: We reserve the right to change subscription prices with reasonable notice. Continued use after price changes constitutes acceptance.
  • Taxes: You are responsible for any applicable taxes associated with your subscription.
  • Payment Failures: If payment fails, we may suspend or terminate your access to the Platform.

5. Acceptable Use Policy

You agree to use the Platform only for lawful purposes and in accordance with these Terms. You agree NOT to:

  • Generate content that depicts minors in any inappropriate, suggestive, or harmful manner
  • Create content that promotes violence, terrorism, or hatred against individuals or groups
  • Generate images that infringe on the intellectual property rights of others
  • Create deepfakes or deceptive content intended to mislead or harm others
  • Use the Platform for any illegal activities or to facilitate illegal conduct
  • Attempt to reverse engineer, decompile, or hack the Platform
  • Circumvent any rate limits, access controls, or security measures
  • Share your account credentials with others or resell access to the Platform
  • Use automated tools to scrape or extract data from the Platform without permission
  • Interfere with or disrupt the integrity or performance of the Platform

Violation of this Acceptable Use Policy may result in immediate termination of your account without refund.

6. Content and Intellectual Property

Your Content: You retain ownership of the prompts you create and, subject to applicable AI model licenses, the images you generate using the Platform.

License to Us: By using the Platform, you grant us a non-exclusive, worldwide, royalty-free license to use, process, and store your content solely for the purpose of providing our services.

Our Content: The Platform, including its design, features, code, and documentation, is owned by Aiunivers and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our permission.

AI-Generated Content: Images generated using our AI models may be subject to the licensing terms of the underlying models. You are responsible for ensuring your use complies with applicable licenses.

7. API Usage

If you use our API, the following additional terms apply:

  • You must keep your API keys confidential and secure
  • You are responsible for all activity that occurs using your API keys
  • You must comply with any rate limits and usage quotas
  • You may not use the API to build a competing service
  • You must include appropriate attribution where required

8. Privacy

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

9. Disclaimers

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

  • The Platform will be uninterrupted, secure, or error-free
  • The results obtained from using the Platform will be accurate or reliable
  • Any defects in the Platform will be corrected
  • The Platform will meet your specific requirements

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL AIUNIVERS, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE PLATFORM.

Our total liability for any claims arising from or related to these Terms or the Platform shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.

11. Indemnification

You agree to indemnify, defend, and hold harmless Aiunivers and its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorney's fees, arising out of or in any way connected with:

  • Your access to or use of the Platform
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Content you generate or distribute using the Platform

12. Termination

We may terminate or suspend your account and access to the Platform immediately, without prior notice or liability, for any reason, including but not limited to:

  • Breach of these Terms
  • Violation of the Acceptable Use Policy
  • Fraudulent or illegal activity
  • Non-payment of fees

Upon termination, your right to use the Platform will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on the Platform and updating the "Last updated" date.

Your continued use of the Platform after any changes constitutes acceptance of the new Terms. If you do not agree to the modified Terms, you must stop using the Platform.

14. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the Platform shall be resolved through binding arbitration or in courts of competent jurisdiction.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy and Refund Policy, constitute the entire agreement between you and Aiunivers regarding your use of the Platform and supersede all prior agreements and understandings.
